### sec.36A Saving of ballot papers not in declaration envelopes
This section applies if—
the commission or the returning officer for an electoral district receives an envelope (an outer envelope ) containing a ballot paper and a declaration envelope; but
the ballot paper is not in the declaration envelope.
Members of the commission’s staff must—
examine the contents of the outer envelope under section 36 to determine whether the ballot paper in the outer envelope is to be accepted for counting; and
deal with the ballot paper in the outer envelope under section 36 as if the ballot paper had been in the declaration envelope.

(sec.36A-ssec.1) This section applies if— the commission or the returning officer for an electoral district receives an envelope (an outer envelope ) containing a ballot paper and a declaration envelope; but the ballot paper is not in the declaration envelope.
(sec.36A-ssec.2) Members of the commission’s staff must— examine the contents of the outer envelope under section 36 to determine whether the ballot paper in the outer envelope is to be accepted for counting; and deal with the ballot paper in the outer envelope under section 36 as if the ballot paper had been in the declaration envelope.
- (a) the commission or the returning officer for an electoral district receives an envelope (an outer envelope ) containing a ballot paper and a declaration envelope; but
- (b) the ballot paper is not in the declaration envelope.
