### sec.50 Requirements for holding commercial activity permit
The chief executive may grant the application if the chief executive is satisfied—
the applicant is a suitable person to hold the permit; and
there is adequate insurance cover for the activities proposed to be conducted under the permit.
However, subsection (1) (b) does not apply if the chief executive considers insurance cover is not required having regard to the nature of the activities.
In deciding whether the applicant is a suitable person to hold the permit, the chief executive may—
inquire about the applicant and an associated person of the applicant; and
have regard to any matter relevant to the applicant’s ability to carry on the commercial activities for which the permit is sought in a competent and ethical way.
In this section—
associated person , of the applicant, means—
if the applicant is a corporation—each executive officer of the corporation; or
if the applicant is not a corporation, a person who—
is regularly or usually in charge of the applicant’s business; or
regularly directs staff of the applicant’s business in their duties; or
is in a position to control or substantially influence the applicant’s business.
