### sec.23 Direction to provide additional specimen of breath or saliva
The authorised person may direct the rail safety worker to provide additional specimens for preliminary testing to enable the preliminary test to be carried out if—
the worker fails to provide a sufficient specimen for preliminary testing under section 22 ; or
the worker provides a sufficient specimen for preliminary testing under section 22 but—
the device used for the preliminary test is or becomes defective, precluding its satisfactory operation to analyse the specimen of breath or saliva; or
for any reason, it is not possible to use or continue using the device to conduct the preliminary test; or
for another reason, it is not possible to complete the preliminary test.
The authorised person may direct the rail safety worker to comply with any reasonable requirement for the purpose of providing an additional specimen.
(sec.23-ssec.1) The authorised person may direct the rail safety worker to provide additional specimens for preliminary testing to enable the preliminary test to be carried out if— the worker fails to provide a sufficient specimen for preliminary testing under section 22 ; or the worker provides a sufficient specimen for preliminary testing under section 22 but— the device used for the preliminary test is or becomes defective, precluding its satisfactory operation to analyse the specimen of breath or saliva; or for any reason, it is not possible to use or continue using the device to conduct the preliminary test; or for another reason, it is not possible to complete the preliminary test.
(sec.23-ssec.2) The authorised person may direct the rail safety worker to comply with any reasonable requirement for the purpose of providing an additional specimen.
- (a) the worker fails to provide a sufficient specimen for preliminary testing under section 22 ; or
- (b) the worker provides a sufficient specimen for preliminary testing under section 22 but— (i) the device used for the preliminary test is or becomes defective, precluding its satisfactory operation to analyse the specimen of breath or saliva; or (ii) for any reason, it is not possible to use or continue using the device to conduct the preliminary test; or (iii) for another reason, it is not possible to complete the preliminary test.
