### sec.103B Criminal history check etc.
The chief executive may ask the commissioner of police or other entity for a written report about the criminal history of a person for section 103A (1) or (2) .
Also, the chief executive may ask the commissioner of police or other entity for a brief description of the circumstances of a conviction or charge mentioned in the person’s criminal history.
For subsections (1) and (2) , the chief executive’s request may include the following information—
the person’s name and any other name the chief executive believes the person may use or have used;
the person’s residential address;
the person’s gender and date and place of birth.
After receiving the written report about the criminal history of the person, the chief executive may request further information about the person’s criminal history from the commissioner of police or other entity.
Further information provided under subsection (4) is taken to be part of the person’s criminal history check.
Subject to subsection (7) , the commissioner of police must comply with a request under this section.
The commissioner of police’s obligation to comply with the request applies only to information in the possession of the commissioner or to which the commissioner has access.
The Criminal Law (Rehabilitation of Offenders) Act 1986 does not apply to the asking for, or giving of, the information mentioned under this section.

(sec.103B-ssec.1) The chief executive may ask the commissioner of police or other entity for a written report about the criminal history of a person for section 103A (1) or (2) .
(sec.103B-ssec.2) Also, the chief executive may ask the commissioner of police or other entity for a brief description of the circumstances of a conviction or charge mentioned in the person’s criminal history.
(sec.103B-ssec.3) For subsections (1) and (2) , the chief executive’s request may include the following information— the person’s name and any other name the chief executive believes the person may use or have used; the person’s residential address; the person’s gender and date and place of birth.
(sec.103B-ssec.4) After receiving the written report about the criminal history of the person, the chief executive may request further information about the person’s criminal history from the commissioner of police or other entity.
(sec.103B-ssec.5) Further information provided under subsection (4) is taken to be part of the person’s criminal history check.
(sec.103B-ssec.6) Subject to subsection (7) , the commissioner of police must comply with a request under this section.
(sec.103B-ssec.7) The commissioner of police’s obligation to comply with the request applies only to information in the possession of the commissioner or to which the commissioner has access.
(sec.103B-ssec.8) The Criminal Law (Rehabilitation of Offenders) Act 1986 does not apply to the asking for, or giving of, the information mentioned under this section.
