### sec.103A Persons for whom security and criminal history checks may be conducted The chief executive may conduct a security check and criminal history check for the following— an applicant for a possession licence for a security enhanced source; an applicant for a transport licence for a security enhanced source; if an applicant mentioned in paragraph (a) or (b) is a corporation, the nominated person for the applicant; an applicant for a use licence for a portable security enhanced source; a person who is to have access to a security enhanced source under the approved security plan for the source if— requested in the approved form by the possession licensee for the source; and the request is accompanied by the written consent of the person who is to have access to the source; a person who is to have access to a security enhanced source under the approved transport security plan for the transport of the source if— requested in the approved form by the transport security plan holder for the source; and the request is accompanied by the written consent of the person who is to have access to the source. The chief executive may conduct a criminal history check for an applicant for an Act instrument if the chief executive knows, or reasonably suspects, that the applicant has been convicted of an indictable offence.
