### sec.43 Protection from liability
An official does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
If subsection (1) prevents a civil liability attaching to the official, the liability instead attaches to the State.
This section does not apply to an official if the official is a prescribed person within the meaning of the Public Sector Act 2022 , section 267 .
For protection from civil liability in relation to prescribed persons, see the Public Sector Act 2022 , section 269 .
In this section—
official means—
the Minister; or
a commissioner; or
a member of the commission’s staff.
