### sec.41 Application of particular State Acts To the extent the operator is performing a titles registry function, the operator is— a unit of public administration under the Crime and Corruption Act 2001 , section 20 ; and a public authority under the Information Privacy Act 2009 , section 21 ; and a public authority under the Public Records Act 2023 , section 8 ; and a public authority under the Right to Information Act 2009 , section 16 . Also, the operator is a public entity under the Human Rights Act 2019 , section 9 , to the extent the operator is performing— a titles registry function; or another function of a public nature under the Human Rights Act 2019 , section 10 . The operator is an entity mentioned in subsection (1) (b) , (c) and (d) only in relation to a document received, created or otherwise in the possession of the operator in performing the titles registry function. For applying subsection(1)(d), a reference in the Right to Information Act 2009 , section 113 to the responsible Minister is a reference to the Minister administering the Land Title Act 1994 . This section applies despite a provision of an Act mentioned in subsection (1) or (2) . s 41 amd 2023 No. 33 s 107 sch 5 ; 2023 No. 32 s 141 s ch 1 pt 2 (sec.41-ssec.1) To the extent the operator is performing a titles registry function, the operator is— a unit of public administration under the Crime and Corruption Act 2001 , section 20 ; and a public authority under the Information Privacy Act 2009 , section 21 ; and a public authority under the Public Records Act 2023 , section 8 ; and a public authority under the Right to Information Act 2009 , section 16 . (sec.41-ssec.2) Also, the operator is a public entity under the Human Rights Act 2019 , section 9 , to the extent the operator is performing— a titles registry function; or another function of a public nature under the Human Rights Act 2019 , section 10 . (sec.41-ssec.3) The operator is an entity mentioned in subsection (1) (b) , (c) and (d) only in relation to a document received, created or otherwise in the possession of the operator in performing the titles registry function. (sec.41-ssec.4) For applying subsection(1)(d), a reference in the Right to Information Act 2009 , section 113 to the responsible Minister is a reference to the Minister administering the Land Title Act 1994 . (sec.41-ssec.5) This section applies despite a provision of an Act mentioned in subsection (1) or (2) . - (a) a unit of public administration under the Crime and Corruption Act 2001 , section 20 ; and - (b) a public authority under the Information Privacy Act 2009 , section 21 ; and - (c) a public authority under the Public Records Act 2023 , section 8 ; and - (d) a public authority under the Right to Information Act 2009 , section 16 . - (a) a titles registry function; or - (b) another function of a public nature under the Human Rights Act 2019 , section 10 .
