### sec.21A Declaration by Minister
The Minister may declare a non-government business activity to be a monopoly business activity.
The declaration must be made by gazette notice.
In deciding whether to make the declaration, the Minister must—
have regard to—
the relevant declaration criteria; and
any information or advice about the criteria given to the Minister by the authority; and
consult with the person carrying on the activity.
A declaration must identify the non-government business activity by reference to the person carrying on the activity.
A declaration continues in operation until it is revoked.

(sec.21A-ssec.1) The Minister may declare a non-government business activity to be a monopoly business activity.
(sec.21A-ssec.2) The declaration must be made by gazette notice.
(sec.21A-ssec.3) In deciding whether to make the declaration, the Minister must— have regard to— the relevant declaration criteria; and any information or advice about the criteria given to the Minister by the authority; and consult with the person carrying on the activity.
