### sec.170P Factors affecting making of declaration
The Minister must declare a candidate water supply activity to be a monopoly water supply activity if the Minister is satisfied about all of the water supply criteria for the activity.
The Minister must decide not to declare a candidate water supply activity to be a monopoly water supply activity if the Minister is not satisfied about all of the water supply criteria for the activity.
Despite subsections (1) and (2) , the Minister may declare part of a candidate water supply activity to be a monopoly water supply activity if the Minister is satisfied about all of the water supply criteria for the part of the activity.

(sec.170P-ssec.1) The Minister must declare a candidate water supply activity to be a monopoly water supply activity if the Minister is satisfied about all of the water supply criteria for the activity.
