### sec.58 Application for leave to withdraw application or referral
An application for the tribunal’s leave to withdraw an application or referral under section 46 (2) of the Act must be—
made—
if the president has made a practice direction stating the way the application is to be made—in the way stated in the practice direction; or
otherwise—in the approved form; and
filed.
A person applying for the tribunal’s leave to withdraw an application or referral under section 46 (2) of the Act must give notice of the application to—
each person to whom a copy of the application or referral was given under section 37 of the Act ; and
any person the tribunal directs to be given notice of the application.

(sec.58-ssec.1) An application for the tribunal’s leave to withdraw an application or referral under section 46 (2) of the Act must be— made— if the president has made a practice direction stating the way the application is to be made—in the way stated in the practice direction; or otherwise—in the approved form; and filed.
(sec.58-ssec.2) A person applying for the tribunal’s leave to withdraw an application or referral under section 46 (2) of the Act must give notice of the application to— each person to whom a copy of the application or referral was given under section 37 of the Act ; and any person the tribunal directs to be given notice of the application.
- (a) made— (i) if the president has made a practice direction stating the way the application is to be made—in the way stated in the practice direction; or (ii) otherwise—in the approved form; and
- (i) if the president has made a practice direction stating the way the application is to be made—in the way stated in the practice direction; or
- (ii) otherwise—in the approved form; and
- (b) filed.
