### sec.54 Protection from liability
An official does not incur civil liability for an act done, or an omission made, honestly and without negligence under this Act.
If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the academy.
Subsection (1) does not apply to an official who is a prescribed person under the Public Sector Act 2022 , section 268 .
For protection from civil liability in relation to prescribed persons under the Public Sector Act 2022 , section 268 , see section 269 of that Act.
In this section—
official means—
a board member; or
the chief executive officer.
(sec.54-ssec.1) An official does not incur civil liability for an act done, or an omission made, honestly and without negligence under this Act.
(sec.54-ssec.2) If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the academy.
(sec.54-ssec.3) Subsection (1) does not apply to an official who is a prescribed person under the Public Sector Act 2022 , section 268 . For protection from civil liability in relation to prescribed persons under the Public Sector Act 2022 , section 268 , see section 269 of that Act.
(sec.54-ssec.4) In this section— official means— a board member; or the chief executive officer.
