### sec.30 Single sex accommodation It is not unlawful for a person to discriminate on the basis of sex against another person with respect to a matter that is otherwise prohibited under subdivision 1 if the other person is required to live in accommodation supplied by the first person and— the accommodation is not equipped with separate sleeping accommodation for people of each sex; and the accommodation is already occupied by a person or people of one sex and is not occupied by anyone of the opposite sex; and the supply of separate sleeping accommodation for people of each sex would impose unjustifiable hardship on the first person. Whether the supply of separate sleeping accommodation for people of each sex would impose unjustifiable hardship on a person depends on all the relevant circumstances of the case, including, for example— the nature of the accommodation; and the cost of supplying the separate sleeping accommodation and the number of people who would benefit or be disadvantaged; and the financial circumstances of the person; and the disruption that supplying the separate sleeping accommodation might cause; and the nature of any benefit or detriment to all people concerned.
