### sec.198 Excessive distribution costs
This section applies if—
the relief sought in a representative complaint is or includes payment of money to the class members for the complaint, other than for costs; and
on application by the respondent, the tribunal considers it is likely that, if an order were to be made in favour of the complainant, the cost to the respondent of identifying the class members for the complaint and distributing to them the amounts ordered to be paid to them would be excessive, having regard to the likely total of those amounts.
The tribunal may, by order—
direct that the complaint no longer continue as a representative complaint; or
stay the complaint so far as it relates to relief of the kind mentioned in subsection (1) (a) .

(sec.198-ssec.2) The tribunal may, by order— direct that the complaint no longer continue as a representative complaint; or stay the complaint so far as it relates to relief of the kind mentioned in subsection (1) (a) .
- (a) the relief sought in a representative complaint is or includes payment of money to the class members for the complaint, other than for costs; and
- (b) on application by the respondent, the tribunal considers it is likely that, if an order were to be made in favour of the complainant, the cost to the respondent of identifying the class members for the complaint and distributing to them the amounts ordered to be paid to them would be excessive, having regard to the likely total of those amounts.
- (a) direct that the complaint no longer continue as a representative complaint; or
- (b) stay the complaint so far as it relates to relief of the kind mentioned in subsection (1) (a) .
