### sec.140A Dealing with complaint under Human Rights Act 2019 This section applies if the commissioner considers a complaint made or referred to the commissioner under this Act would be more appropriately dealt with by the commission as a complaint about an alleged contravention of the Human Rights Act 2019 . The commissioner may, with the consent of the complainant, deal with the complaint under the Human Rights Act 2019 as an alleged contravention of that Act. For dealing with the complaint as mentioned in subsection (2) , the complaint— is taken to be a complaint about an alleged contravention of the Human Rights Act 2019 that is accepted by the commissioner under section 76 of that Act; and is taken to be made on the day the complaint was made or referred under this Act. s 140A ins 2019 No. 5 s 113 (sec.140A-ssec.1) This section applies if the commissioner considers a complaint made or referred to the commissioner under this Act would be more appropriately dealt with by the commission as a complaint about an alleged contravention of the Human Rights Act 2019 . (sec.140A-ssec.2) The commissioner may, with the consent of the complainant, deal with the complaint under the Human Rights Act 2019 as an alleged contravention of that Act. (sec.140A-ssec.3) For dealing with the complaint as mentioned in subsection (2) , the complaint— is taken to be a complaint about an alleged contravention of the Human Rights Act 2019 that is accepted by the commissioner under section 76 of that Act; and is taken to be made on the day the complaint was made or referred under this Act. - (a) is taken to be a complaint about an alleged contravention of the Human Rights Act 2019 that is accepted by the commissioner under section 76 of that Act; and - (b) is taken to be made on the day the complaint was made or referred under this Act.
