### sec.117ZK Minister may request criminal history reports
To decide if a person is disqualified from becoming or continuing as an appointed board member under section 117ZF (a) , the Minister may ask the commissioner of the police service for—
a written report about the criminal history of the person; and
a brief description of the circumstances of a conviction mentioned in the criminal history.
However, the Minister may make the request only if the person has given the Minister written consent for the request.
The commissioner of the police service must comply with the request.
However, the duty to comply applies only to information in the possession of the commissioner of the police service or to which the commissioner of the police service has access.
In this section—
criminal history , for a person, means the person’s criminal history as defined under the Criminal Law (Rehabilitation of Offenders) Act 1986 , other than spent convictions.
