### sec.16 Who is a chief executive
A chief executive , in relation to a public sector entity, is—
for a department—the individual appointed under this Act as the chief executive of the department; or
for a public service entity mentioned in section 9 (b) —the head of the entity; or
for another public sector entity—
if a regulation prescribes a position for this subparagraph—the individual who holds the prescribed position; or
otherwise—the individual responsible for the day- to-day management of the entity or the entity’s affairs, whether or not the individual is subject to the direction of, or reports to, a governing body of the entity.
- (a) for a department—the individual appointed under this Act as the chief executive of the department; or
- (b) for a public service entity mentioned in section 9 (b) —the head of the entity; or
- (c) for another public sector entity— (i) if a regulation prescribes a position for this subparagraph—the individual who holds the prescribed position; or (ii) otherwise—the individual responsible for the day- to-day management of the entity or the entity’s affairs, whether or not the individual is subject to the direction of, or reports to, a governing body of the entity.
