### sec.38 Retirement deemed effective in particular case
If the death of an officer on suspension occurs while, pursuant to this part, his or her notice of retirement is not effective, it shall be deemed for the purpose of establishing his or her entitlement to superannuation or retirement benefits that his or her retirement became effective immediately before his or her death.
