Where an owner who has paid an amount of fees or charges pursuant to subsection (1) is not the convicted person in relation to whom the relevant property is in the custody and control of the public trustee pursuant to a restraining order, that owner may recover the amount as a debt due and owing to the owner by the convicted person by action in a court of competent jurisdiction.
