### sec.159 Application of Act to certain licences relating to establishments previously registered
This section applies if—
a person is—
the proprietor of an establishment ( the premises )—
registered under part 15 of the former regulation immediately before the commencement; or
registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
an applicant for registration of an establishment (also the premises ) made under part 15 of the former regulation pending immediately before the commencement; and
services being provided, or to be provided, at the premises are higher risk personal appearance services; and
a licence relating to the premises is subsequently issued under this Act.
This Act applies to the licence mentioned in subsection (1)(c).
However, if a regulation states that for a licence issued before a stated date, section 41(1)(b)(iii) and (iv) does not apply to the licence until a stated date, section 41(1)(b)(iii) and (iv) does not apply to the licence until the date.
The stated date under subsection (3) must not be more than 1 year after the commencement.
(sec.159-ssec.1) This section applies if— a person is— the proprietor of an establishment ( the premises )— registered under part 15 of the former regulation immediately before the commencement; or registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or an applicant for registration of an establishment (also the premises ) made under part 15 of the former regulation pending immediately before the commencement; and services being provided, or to be provided, at the premises are higher risk personal appearance services; and a licence relating to the premises is subsequently issued under this Act.
(sec.159-ssec.2) This Act applies to the licence mentioned in subsection (1)(c).
(sec.159-ssec.3) However, if a regulation states that for a licence issued before a stated date, section 41(1)(b)(iii) and (iv) does not apply to the licence until a stated date, section 41(1)(b)(iii) and (iv) does not apply to the licence until the date.
(sec.159-ssec.4) The stated date under subsection (3) must not be more than 1 year after the commencement.
- (a) a person is— (i) the proprietor of an establishment ( the premises )— (A) registered under part 15 of the former regulation immediately before the commencement; or (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or (ii) an applicant for registration of an establishment (also the premises ) made under part 15 of the former regulation pending immediately before the commencement; and
- (i) the proprietor of an establishment ( the premises )— (A) registered under part 15 of the former regulation immediately before the commencement; or (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
- (A) registered under part 15 of the former regulation immediately before the commencement; or
- (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
- (ii) an applicant for registration of an establishment (also the premises ) made under part 15 of the former regulation pending immediately before the commencement; and
- (b) services being provided, or to be provided, at the premises are higher risk personal appearance services; and
- (c) a licence relating to the premises is subsequently issued under this Act.
- (i) the proprietor of an establishment ( the premises )— (A) registered under part 15 of the former regulation immediately before the commencement; or (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
- (A) registered under part 15 of the former regulation immediately before the commencement; or
- (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
- (ii) an applicant for registration of an establishment (also the premises ) made under part 15 of the former regulation pending immediately before the commencement; and
- (A) registered under part 15 of the former regulation immediately before the commencement; or
- (B) registered under part 15 of the former regulation before the commencement and for which an application for renewal is pending immediately before the commencement; or
