71 Abatement notice—implementation
implement an abatement notice after the expiration of the compliance
period specified under section 69 (3) (b) (as extended, if at all, under
section 70).
(2) An authorised officer must only implement an abatement notice under
subsection (1) if the officer has reasonable grounds for believing that
it is necessary to do so to avert an imminent and serious risk to public
health.
(3) For the purpose of implementing an abatement notice under
(a) enter a place to which the notice relates at any reasonable time;
or
(b) enter a place to which the notice relates at any time, if the officer
has reasonable grounds for believing that the circumstances are
of such seriousness or urgency as to require such immediate
entry.
(4) An authorised officer who enters a place pursuant to subsection (3) is
not entitled to remain there if, on request by the occupier, the
authorised officer does not produce the officer’s identity card, and,
(5) Any costs or expenses incurred by the Territory in implementing, or
attempting to implement, an abatement notice under this section are
a debt due to the Territory by the person to whom the notice was
