### sec.172 Meaning of lease terminable at will
A lease of land is a lease terminable at will if—
the lessee is in possession of the land, although the lessor and the lessee have not agreed, expressly or impliedly, to the duration of the term of the lease; or
the lessee remains in possession of the land with the lessor’s consent, although the term of the lease has ended, and the lessor and the lessee have not agreed, expressly or impliedly, that the lessee may continue in possession for another period.
- (a) the lessee is in possession of the land, although the lessor and the lessee have not agreed, expressly or impliedly, to the duration of the term of the lease; or
- (b) the lessee remains in possession of the land with the lessor’s consent, although the term of the lease has ended, and the lessor and the lessee have not agreed, expressly or impliedly, that the lessee may continue in possession for another period.
