### sec.40 Withdrawal of complaint
If a complainant withdraws a complaint, the board need not take any further action about the complaint.
However, the withdrawal does not stop the board—
investigating, or continuing to investigate, the matter of the complaint; or
authorising an investigator to investigate, or continue to investigate, the matter of the complaint.
In deciding whether to act as mentioned in subsection (2) , the board must have regard to the main objects of this Act and the grounds for disciplining a registered professional engineer.
For the grounds for disciplining a registered professional engineer, see section 36 .
(sec.40-ssec.1) If a complainant withdraws a complaint, the board need not take any further action about the complaint.
(sec.40-ssec.2) However, the withdrawal does not stop the board— investigating, or continuing to investigate, the matter of the complaint; or authorising an investigator to investigate, or continue to investigate, the matter of the complaint.
