### sec.10.21BA Wilfully and unlawfully killing or seriously injuring police dog or police horse
A person must not wilfully and unlawfully kill or cause serious injury to a police dog or police horse—
that is being used by a police officer in the performance of the officer’s duties; or
because of, or in retaliation for, its use by a police officer in the performance of the officer’s duties.
Maximum penalty—5 years imprisonment.
A person must not attempt to commit an offence against subsection (1) .

An offence against subsection (1) or (2) is a crime.
A court that finds a person guilty of an offence against subsection (1) or (2) may, in addition to any penalty that may be imposed, order the person to pay to the commissioner a reasonable amount for—
the treatment, care, rehabilitation and retraining of the police dog or police horse concerned; or
if it is necessary to replace the police dog or police horse—buying and training its replacement.
