### sec.824 Taking of certain DNA samples
This section applies in relation to the pre-amended Act, sections 310, 311 and 316.
Despite the omission of the sections by the amending Act—
the declarations in the pre-amended Act, sections 310(4), 311(4) and 316(5) continue to have effect in relation to the offences to which they applied immediately before the commencement; and
a DNA sample taken as mentioned in the pre-amended Act, section 310(5) or 311(5) continues not to have been unlawfully taken merely because the indictable offence of which the person from whom it was taken was found guilty was dealt with summarily.

(sec.824-ssec.1) This section applies in relation to the pre-amended Act, sections 310, 311 and 316.

- (a) the declarations in the pre-amended Act, sections 310(4), 311(4) and 316(5) continue to have effect in relation to the offences to which they applied immediately before the commencement; and
- (b) a DNA sample taken as mentioned in the pre-amended Act, section 310(5) or 311(5) continues not to have been unlawfully taken merely because the indictable offence of which the person from whom it was taken was found guilty was dealt with summarily.
