### sec.498 Examination if proceeding started against adult by arrest, notice to appear or complaint and summons This section applies if a police officer— starts or continues a proceeding for an indictable offence against an adult by arrest; or starts a proceeding for an indictable offence against an adult by notice to appear or complaint and summons. A police officer may detain the person for a reasonable time, of not more than 1 hour, to obtain the approval of an authorised police officer under subsection (3) to perform a non-medical examination on the person. A police officer may, with the approval of an authorised police officer, detain the person for the time reasonably necessary to perform the examination on the person and, if necessary, take the person to a place with appropriate facilities for performing the examination. Before approving the detention of the person, the authorised police officer must be satisfied performing the examination may provide evidence of the commission of an indictable offence. An authorised examiner may perform a non-medical examination on a person detained under an approval of an authorised police officer under this section. s 498 ins 2003 No. 49 s 10 (sec.498-ssec.1) This section applies if a police officer— starts or continues a proceeding for an indictable offence against an adult by arrest; or starts a proceeding for an indictable offence against an adult by notice to appear or complaint and summons.
