### sec.888 Applications in response to public notice
This section applies if—
a notice of intention to grant mentioned in section 887(1) had not been given before 31 December 2004; and
the application was made in response to a public notice, published by the Minister or the department, inviting applications for a 1923 Act ATP; and
the notice complies, or substantially complies with section 35(2).
The public notice is taken to be a call for tenders for a proposed authority to prospect.
The call is taken to have been made when the public notice was published.
The closing time for the call is taken to be the day stated in the public notice by which applications must be submitted.
The application is taken to be a tender, under chapter 2, part 1, division 2, for the proposed authority, made in response to the call.
