### sec.705D Reporting of designated accident or incident
This section applies to the operator of operating plant, other than a coal mining-CSG operating plant, operated in the area of a coal or oil shale mining lease.
The operator must, as soon as possible after becoming aware that a designated accident or incident has happened, notify the site senior executive under the Coal Mining Safety and Health Act for the coal mine the subject of the coal or oil shale mining lease about the accident or incident, either orally or by notice.
If the operator makes an oral report under subsection (2) , the operator must confirm the report by notice within 48 hours.
In this section—
designated accident or incident means an accident or incident as follows that relates to the safety of any coal mining operation—
an accident that causes—
the death of a person; or
a person to be admitted to a hospital as an in-patient for treatment for a bodily injury endangering, or likely to endanger, the person’s life; or
a person to suffer an injury causing, or likely to cause, a permanent injury to the person’s health;
an incident the operator of the plant is required to report to the chief inspector under section 706 , to the extent the incident affects, or is likely to affect, the safety and health of coal mine workers.

(sec.705D-ssec.1) This section applies to the operator of operating plant, other than a coal mining-CSG operating plant, operated in the area of a coal or oil shale mining lease.

- (a) an accident that causes— (i) the death of a person; or (ii) a person to be admitted to a hospital as an in-patient for treatment for a bodily injury endangering, or likely to endanger, the person’s life; or (iii) a person to suffer an injury causing, or likely to cause, a permanent injury to the person’s health;
- (i) the death of a person; or
- (ii) a person to be admitted to a hospital as an in-patient for treatment for a bodily injury endangering, or likely to endanger, the person’s life; or
- (iii) a person to suffer an injury causing, or likely to cause, a permanent injury to the person’s health;
- (b) an incident the operator of the plant is required to report to the chief inspector under section 706 , to the extent the incident affects, or is likely to affect, the safety and health of coal mine workers.
- (i) the death of a person; or
- (ii) a person to be admitted to a hospital as an in-patient for treatment for a bodily injury endangering, or likely to endanger, the person’s life; or
- (iii) a person to suffer an injury causing, or likely to cause, a permanent injury to the person’s health;
