### sec.80P Compensation for exercise of remedial powers This section applies if an owner or occupier of land (the claimant ) suffers a cost, damage or loss because of the exercise, or purported exercise, of remedial powers. Compensation is payable to the claimant by the State for the cost, damage or loss. The compensation may be claimed and ordered in a proceeding brought in a court of competent jurisdiction. The court may order the compensation only if it is satisfied it is just to make the order in the circumstances of the particular case. s 80P ins 2004 No. 26 s 46 (sec.80P-ssec.1) This section applies if an owner or occupier of land (the claimant ) suffers a cost, damage or loss because of the exercise, or purported exercise, of remedial powers.
