### sec.39G Deciding application
The chief executive must decide whether to approve the application.
In deciding the application, the chief executive must consider whether the land the subject of the application will, or is likely to, be used or dealt with under this Act in a way that is inconsistent with the grant of the proposed right.
The chief executive may grant the application subject to conditions.

(sec.39G-ssec.1) The chief executive must decide whether to approve the application.
