### sec.186 Replacement certificates
A motor salesperson may apply to the chief executive for the replacement of a lost, stolen, destroyed or damaged registration certificate.
The application must be made in the approved form and be accompanied by the fee prescribed under a regulation.
The chief executive must grant the application if the chief executive is satisfied the original certificate has been lost, stolen or destroyed, or damaged in a way to require its replacement.
If the chief executive grants the application made under subsection (1) , the chief executive must issue another registration certificate to the applicant to replace the original certificate.
The chief executive may also replace a registration certificate if—
either—
the holder of the certificate has given written notice to the chief executive of a prescribed change; or
the chief executive reasonably believes a prescribed change for the holder of the certificate has happened; and
the chief executive is satisfied the prescribed change requires a replacement of the certificate.
If the chief executive replaces a registration certificate under this section—
the certificate continues to be subject to the same conditions and term that the certificate was subject to before being replaced; and
the holder of the certificate must pay the chief executive the fee prescribed under a regulation.
In this section—
prescribed change means a prescribed change under section 188 .
(sec.186-ssec.1) A motor salesperson may apply to the chief executive for the replacement of a lost, stolen, destroyed or damaged registration certificate.
(sec.186-ssec.2) The application must be made in the approved form and be accompanied by the fee prescribed under a regulation.
(sec.186-ssec.3) The chief executive must grant the application if the chief executive is satisfied the original certificate has been lost, stolen or destroyed, or damaged in a way to require its replacement.
(sec.186-ssec.4) If the chief executive grants the application made under subsection (1) , the chief executive must issue another registration certificate to the applicant to replace the original certificate.
(sec.186-ssec.5) The chief executive may also replace a registration certificate if— either— the holder of the certificate has given written notice to the chief executive of a prescribed change; or the chief executive reasonably believes a prescribed change for the holder of the certificate has happened; and the chief executive is satisfied the prescribed change requires a replacement of the certificate.
(sec.186-ssec.6) If the chief executive replaces a registration certificate under this section— the certificate continues to be subject to the same conditions and term that the certificate was subject to before being replaced; and the holder of the certificate must pay the chief executive the fee prescribed under a regulation.
(sec.186-ssec.7) In this section— prescribed change means a prescribed change under section 188 .
- (a) either— (i) the holder of the certificate has given written notice to the chief executive of a prescribed change; or (ii) the chief executive reasonably believes a prescribed change for the holder of the certificate has happened; and
- (i) the holder of the certificate has given written notice to the chief executive of a prescribed change; or
- (ii) the chief executive reasonably believes a prescribed change for the holder of the certificate has happened; and
- (b) the chief executive is satisfied the prescribed change requires a replacement of the certificate.
- (i) the holder of the certificate has given written notice to the chief executive of a prescribed change; or
- (ii) the chief executive reasonably believes a prescribed change for the holder of the certificate has happened; and
- (a) the certificate continues to be subject to the same conditions and term that the certificate was subject to before being replaced; and
- (b) the holder of the certificate must pay the chief executive the fee prescribed under a regulation.
