### sec.124 Licensee to be in charge of chattel auctioneer’s business at a place
A chattel auctioneer who is an individual and a principal licensee must—
be in charge of the chattel auctioneer’s business at the chattel auctioneer’s registered office; and
if the chattel auctioneer has more than 1 place of business, ensure that at each other place of business an individual who is a chattel auctioneer is in charge of the chattel auctioneer’s business at the place.
Maximum penalty—200 penalty units.
A chattel auctioneer that is a corporation and a principal licensee ( corporate chattel auctioneer ) must ensure that—
the individual in charge of the corporate chattel auctioneer’s business at its registered office is a chattel auctioneer; and
if the corporate chattel auctioneer has more than 1 place of business, at each other place of business an individual who is a chattel auctioneer is in charge of the corporate chattel auctioneer’s business at the place.
Maximum penalty—
for an individual guilty under the Criminal Code , chapter 2 of an offence—200 penalty units; or
for a corporation—1,000 penalty units.
An individual must not be in charge of a chattel auctioneer’s business at more than 1 place of business.
Maximum penalty—200 penalty units.
It is not an offence against this section for a chattel auctioneer who is an individual to be in charge of more than 1 place of business if each place of business is on land contiguous to land on which the other place of business is located.
For subsection (4) , land is contiguous with other land only if the parcels of land have a common boundary that is not separated by a public road.
