### sec.166 Directive may be given orally or by notice
A directive under subdivision 3 or 4 may be given to a person orally or by notice.
However, if a directive is given to a person orally, the directive must be confirmed by notice to the person as soon as reasonably practicable after the directive is given.
A copy of a notice given under subsection (1) or (2) must be given to—
the site senior executive for the mine, or part of the mine, to which the directive relates; and
the person in control of the mine, or part of the mine, to which the directive relates.
Failure to comply with subsection (2) or (3) does not affect the validity of the directive.
Also, a directive is not invalid only because of—
a formal defect or irregularity in a notice given under this section unless the defect or irregularity causes or is likely to cause substantial injustice; or
a failure to use the correct name of a person in a notice given under this section if the notice sufficiently identifies the person.

(sec.166-ssec.1) A directive under subdivision 3 or 4 may be given to a person orally or by notice.
