### sec.24 Grant of prospecting permit
The chief executive may grant a prospecting permit for land if the chief executive is satisfied an eligible person has—
made a genuine application that complies with this chapter, and otherwise complied with the requirements of this Act; and
deposited the amount of security required to be deposited for the permit.
If the application relates to acquired land, see also section 10AAC .
If the chief executive is of the opinion that an applicant for a prospecting permit had previously contravened or failed to comply with any provision of this Act, the repealed Acts, any other Act about mining or the Fossicking Act 1994 , the chief executive may, whether or not that person had been charged or convicted of an offence in respect of that contravention or failure to comply, reject the application.
For subsection (2) , a company is taken to have contravened a provision of this Act if the person contravening the provision is—
an officer or employee of the company; or
someone else who is in a position to control or substantially influence the company’s affairs.

(sec.24-ssec.1) The chief executive may grant a prospecting permit for land if the chief executive is satisfied an eligible person has— made a genuine application that complies with this chapter, and otherwise complied with the requirements of this Act; and deposited the amount of security required to be deposited for the permit. (sec.24-ssec.2) If the chief executive is of the opinion that an applicant for a prospecting permit had previously contravened or failed to comply with any provision of this Act, the repealed Acts, any other Act about mining or the Fossicking Act 1994 , the chief executive may, whether or not that person had been charged or convicted of an offence in respect of that contravention or failure to comply, reject the application.
(sec.24-ssec.3) For subsection (2) , a company is taken to have contravened a provision of this Act if the person contravening the provision is— an officer or employee of the company; or someone else who is in a position to control or substantially influence the company’s affairs.
- (a) made a genuine application that complies with this chapter, and otherwise complied with the requirements of this Act; and
- (b) deposited the amount of security required to be deposited for the permit.
