### sec.245 Election notice
This section applies if, before the commencement—
a party gave, under section 88 as in force before the commencement, another party an election notice—
asking for an authorised officer to call a conference to negotiate a conduct and compensation agreement; or
calling upon the party to agree to an ADR to negotiate a conduct and compensation agreement; and
the conference was not finished under section 89 as in force before the commencement, or the ADR was not finished under section 90 as in force before the commencement.
The Act , as in force immediately before the commencement, continues to apply in relation to—
the conference or ADR; and
any proceeding in the Land Court, whether started before or after the commencement, that relates to the concerns the subject of the conference or ADR.
The new arbitration provisions do not apply in relation to the concerns the subject of the conference or ADR.
In this section—
new arbitration provisions means the provisions inserted into chapter 3 under the Mineral, Water and Other Legislation Amendment Act 2018 .

(sec.245-ssec.2) The Act , as in force immediately before the commencement, continues to apply in relation to— the conference or ADR; and any proceeding in the Land Court, whether started before or after the commencement, that relates to the concerns the subject of the conference or ADR.
(sec.245-ssec.3) The new arbitration provisions do not apply in relation to the concerns the subject of the conference or ADR.
(sec.245-ssec.4) In this section— new arbitration provisions means the provisions inserted into chapter 3 under the Mineral, Water and Other Legislation Amendment Act 2018 .
- (a) a party gave, under section 88 as in force before the commencement, another party an election notice— (i) asking for an authorised officer to call a conference to negotiate a conduct and compensation agreement; or (ii) calling upon the party to agree to an ADR to negotiate a conduct and compensation agreement; and
- (i) asking for an authorised officer to call a conference to negotiate a conduct and compensation agreement; or
- (ii) calling upon the party to agree to an ADR to negotiate a conduct and compensation agreement; and
- (b) the conference was not finished under section 89 as in force before the commencement, or the ADR was not finished under section 90 as in force before the commencement.
- (i) asking for an authorised officer to call a conference to negotiate a conduct and compensation agreement; or
- (ii) calling upon the party to agree to an ADR to negotiate a conduct and compensation agreement; and
- (a) the conference or ADR; and
- (b) any proceeding in the Land Court, whether started before or after the commencement, that relates to the concerns the subject of the conference or ADR.
