### sec.202 Basis for increasing site rent under existing site agreement
This section applies if—
a site agreement entered into before the commencement states a basis for working out the amount of an increase in the site rent; and
the basis stated in the site agreement—
is a basis other than a basis prescribed by regulation under new section 69A(1)(b); but
is not a market review of the site rent.
Despite new section 69A, the basis stated in the site agreement continues to have effect.

(sec.202-ssec.1) This section applies if— a site agreement entered into before the commencement states a basis for working out the amount of an increase in the site rent; and the basis stated in the site agreement— is a basis other than a basis prescribed by regulation under new section 69A(1)(b); but is not a market review of the site rent.
(sec.202-ssec.2) Despite new section 69A, the basis stated in the site agreement continues to have effect.
- (a) a site agreement entered into before the commencement states a basis for working out the amount of an increase in the site rent; and
- (b) the basis stated in the site agreement— (i) is a basis other than a basis prescribed by regulation under new section 69A(1)(b); but (ii) is not a market review of the site rent.
