### sec.153 Applications to small claims tribunal
If—
a person has made an application to a small claims tribunal under the repealed Act before the commencement; and
the application has not been decided before the commencement;
the small claims tribunal may decide the application under the repealed Act as if this Act had not commenced.
If—
immediately before the commencement a person could have made an application to a small claims tribunal under the repealed Act; and
the person has not made the application before the commencement;
the person may make the application to a small claims tribunal, and the small claims tribunal may decide the application, under the repealed Act as if this Act had not commenced.
For giving effect to a decision under subsection (1) or (2), the small claims tribunal may make the orders the small claims tribunal considers necessary having regard to the provisions of this Act.
(sec.153-ssec.1) If— a person has made an application to a small claims tribunal under the repealed Act before the commencement; and the application has not been decided before the commencement; the small claims tribunal may decide the application under the repealed Act as if this Act had not commenced.
(sec.153-ssec.2) If— immediately before the commencement a person could have made an application to a small claims tribunal under the repealed Act; and the person has not made the application before the commencement; the person may make the application to a small claims tribunal, and the small claims tribunal may decide the application, under the repealed Act as if this Act had not commenced.
(sec.153-ssec.3) For giving effect to a decision under subsection (1) or (2), the small claims tribunal may make the orders the small claims tribunal considers necessary having regard to the provisions of this Act.
- (a) a person has made an application to a small claims tribunal under the repealed Act before the commencement; and
- (b) the application has not been decided before the commencement;
- (a) immediately before the commencement a person could have made an application to a small claims tribunal under the repealed Act; and
- (b) the person has not made the application before the commencement;
