### sec.324 Process if no investigation policy
This section applies if, on or after the commencement—
a local government is required to deal with the inappropriate conduct of a councillor under chapter 5A, part 3, division 5; and
the local government has not adopted an investigation policy under section 150AE.
The local government must decide, by resolution, the procedure for investigating the conduct.
However, subsections (4) and (5) apply if the assessor has recommended, under section 150AC(3), how the conduct may be dealt with.
The local government must follow the process recommended by the assessor or decide, by resolution, to deal with the complaint in another way.
The local government must state the reasons for its decision in the resolution.

- (a) a local government is required to deal with the inappropriate conduct of a councillor under chapter 5A, part 3, division 5; and
- (b) the local government has not adopted an investigation policy under section 150AE.
