### sec.150DR Vacancy of office
The office of a member becomes vacant if the person holding the office—
completes a term of office and is not reappointed; or
is not qualified under section 150DO to hold the office; or
is removed from office by the Governor in Council because the person—
is mentally or physically incapable of satisfactorily performing the member’s functions; or
has performed the member’s functions carelessly, incompetently or inefficiently; or
has engaged in conduct that would result in dismissal from the public service if the member were a public service officer; or
resigns the office by signed notice given to the Minister.

- (a) completes a term of office and is not reappointed; or
- (b) is not qualified under section 150DO to hold the office; or
- (c) is removed from office by the Governor in Council because the person— (i) is mentally or physically incapable of satisfactorily performing the member’s functions; or (ii) has performed the member’s functions carelessly, incompetently or inefficiently; or (iii) has engaged in conduct that would result in dismissal from the public service if the member were a public service officer; or
- (i) is mentally or physically incapable of satisfactorily performing the member’s functions; or
- (ii) has performed the member’s functions carelessly, incompetently or inefficiently; or
- (iii) has engaged in conduct that would result in dismissal from the public service if the member were a public service officer; or
- (d) resigns the office by signed notice given to the Minister.
- (i) is mentally or physically incapable of satisfactorily performing the member’s functions; or
- (ii) has performed the member’s functions carelessly, incompetently or inefficiently; or
- (iii) has engaged in conduct that would result in dismissal from the public service if the member were a public service officer; or
