### sec.36O Powers of tribunal on applications under this division
In deciding the application, the tribunal may—
grant the application on condition that the licence fee or underpaid amount is paid to the department within a period stated by the tribunal (the time allowed ); or
refuse the application.
The time allowed must be at least 7 days, and not more than 28 days, after the day on which the application is granted.
The continued suspension of the licence under section 36N (5) ends if—
the application is granted and the licence fee or underpaid amount is paid to the department within the time allowed; or
the application is refused and the licence fee or underpaid amount is paid within 1 day of the application being refused.
The licence is cancelled if—
the application is granted but the licence fee or underpaid amount is not paid within the time allowed; or
the application is refused and the licence fee or underpaid amount is not paid within 1 day of the application being refused.
If the licence is cancelled under subsection (4) —
the part of the licence fee for the licence for the licence period in which it was suspended that is proportionate to the part of the licence period that had ended before the suspension started is a debt payable to the State; or
the underpaid amount is a debt payable to the State.
