### sec.238A Disposal of applications for removal An application for removal of a licence under section 49A of the repealed Act, that had not been disposed of before the proclaimed day, may be continued and disposed of as if the chief executive were the Commission. To remove any doubt, it is declared that— since the proclaimed day, the chief executive has had power to perform the functions performed by the Commission under the repealed Act; and the Court’s power under the repealed Act to order that a licence be removed has continued under this part. The chief executive has power to decide whether there is a public need in the locality to which it is proposed to remove a licence on application for removal of the licence under the repealed Act.
