### sec.155AF Exemption from obligation under s 155AD (3)
Subsection (2) applies if—
the licensee or permittee is an individual; and
the licensee or permittee wishes to be absent from the management and supervision of the business conducted under authority of the licence or permit for a continuous period (the relevant period ) of not longer than 3 months.
The licensee or permittee may apply to the commissioner for an exemption from the obligation to comply with section 155AD (3) during the relevant period.
The commissioner may grant the application only if the commissioner is satisfied—
the licensee or permittee has made reasonable efforts, but has been unsuccessful, in engaging 1 or more approved managers to be present or reasonably available, during the hours in the relevant period the licensed premises or premises to which the permit relates will be open for business, at or in relation to the premises; and
during the relevant period—
liquor will be supplied or possessed on the premises only in accordance with the authority conferred by the licence or permit; and
the risk-assessed management plan for the premises will be complied with.
