### sec.639 Constitution of committee for hearing
The chairperson must make arrangements about constituting the committee for hearing and deciding discipline applications.
For hearing and deciding a discipline application made to the committee, the committee is constituted by—
the chairperson; and
a member of the committee who is a local legal practitioner chosen by the chairperson; and
a lay member of the committee chosen by the chairperson.
In choosing a local legal practitioner as mentioned in subsection (2) , the chairperson must choose a person who is—
if the discipline application is about the conduct of a person who, at the time of performing the acts or omitting to do the acts constituting the conduct complained of, was a barrister or, in the opinion of the chairperson, was engaged in legal practice in the manner of a barrister—a barrister; or
otherwise—a solicitor.
The chairperson is to preside at the hearing of a matter referred to the committee.
In this section—
chairperson includes the deputy chairperson.

- (a) the chairperson; and
- (b) a member of the committee who is a local legal practitioner chosen by the chairperson; and
- (c) a lay member of the committee chosen by the chairperson.
- (a) if the discipline application is about the conduct of a person who, at the time of performing the acts or omitting to do the acts constituting the conduct complained of, was a barrister or, in the opinion of the chairperson, was engaged in legal practice in the manner of a barrister—a barrister; or
- (b) otherwise—a solicitor.
