### sec.85 Surrender of land no longer needed for a public purpose
The Minister is authorised to sign a surrender of land, if the Minister is satisfied—
the land was granted for an estate in fee simple for some community, public or similar purpose; and
the land has been used for the purpose; and
the trustees of the land are deceased, untraceable, unknown or incapable of acting; and
the land is no longer needed for a public, community or similar purpose.
The surrendered land may be dealt with as unallocated State land.
(sec.85-ssec.1) The Minister is authorised to sign a surrender of land, if the Minister is satisfied— the land was granted for an estate in fee simple for some community, public or similar purpose; and the land has been used for the purpose; and the trustees of the land are deceased, untraceable, unknown or incapable of acting; and the land is no longer needed for a public, community or similar purpose.
(sec.85-ssec.2) The surrendered land may be dealt with as unallocated State land.
- (a) the land was granted for an estate in fee simple for some community, public or similar purpose; and
- (b) the land has been used for the purpose; and
- (c) the trustees of the land are deceased, untraceable, unknown or incapable of acting; and
- (d) the land is no longer needed for a public, community or similar purpose.
