### sec.176UA Power to require land management agreement in particular circumstances
This section applies for a term or perpetual lease if—
the lease is for rural leasehold land; and
the Minister is satisfied—
the lease land suffers from, or is at risk of, land degradation; or
the lessee is using the lease land in a way that is not fulfilling the lessee’s duty of care for the land, under section 199 .
The Minister, by notice, may require a land management agreement to be entered into for the lease land.
If a land management agreement is entered into under this section the lease is subject to a condition that the lessee must comply with the agreement.

(sec.176UA-ssec.1) This section applies for a term or perpetual lease if— the lease is for rural leasehold land; and the Minister is satisfied— the lease land suffers from, or is at risk of, land degradation; or the lessee is using the lease land in a way that is not fulfilling the lessee’s duty of care for the land, under section 199 .
(sec.176UA-ssec.2) The Minister, by notice, may require a land management agreement to be entered into for the lease land.
(sec.176UA-ssec.3) If a land management agreement is entered into under this section the lease is subject to a condition that the lessee must comply with the agreement.
- (a) the lease is for rural leasehold land; and
- (b) the Minister is satisfied— (i) the lease land suffers from, or is at risk of, land degradation; or (ii) the lessee is using the lease land in a way that is not fulfilling the lessee’s duty of care for the land, under section 199 .
