### sec.157B Deciding not to make offer of new lease before receiving renewal application
The chief executive may decide not to make an offer of a new lease at any time before receiving a renewal application from the lessee of a term lease.
Before deciding not to make an offer of a new lease under subsection (1) , the chief executive must—
give the lessee a notice stating each of the following—
that the chief executive proposes not to make an offer of a new lease;
the reasons for the chief executive’s proposal not to make an offer of a new lease;
that the lessee may, within the reasonable period stated in the notice, make written submissions about any matter relevant to the reasons for the chief executive’s proposal; and
consider any written submissions made by the lessee within the period stated in the notice.
Sections 420FA , 420G and 420H apply in relation to making a decision under subsection (1) —
as if a reference in the sections to deciding or refusing an application were a reference to making the decision; and
with other necessary changes.

(sec.157B-ssec.1) The chief executive may decide not to make an offer of a new lease at any time before receiving a renewal application from the lessee of a term lease.
(sec.157B-ssec.2) Before deciding not to make an offer of a new lease under subsection (1) , the chief executive must— give the lessee a notice stating each of the following— that the chief executive proposes not to make an offer of a new lease; the reasons for the chief executive’s proposal not to make an offer of a new lease; that the lessee may, within the reasonable period stated in the notice, make written submissions about any matter relevant to the reasons for the chief executive’s proposal; and consider any written submissions made by the lessee within the period stated in the notice.
(sec.157B-ssec.3) Sections 420FA , 420G and 420H apply in relation to making a decision under subsection (1) — as if a reference in the sections to deciding or refusing an application were a reference to making the decision; and with other necessary changes.
- (a) give the lessee a notice stating each of the following— (i) that the chief executive proposes not to make an offer of a new lease; (ii) the reasons for the chief executive’s proposal not to make an offer of a new lease; (iii) that the lessee may, within the reasonable period stated in the notice, make written submissions about any matter relevant to the reasons for the chief executive’s proposal; and
- (i) that the chief executive proposes not to make an offer of a new lease;
- (ii) the reasons for the chief executive’s proposal not to make an offer of a new lease;
- (iii) that the lessee may, within the reasonable period stated in the notice, make written submissions about any matter relevant to the reasons for the chief executive’s proposal; and
- (b) consider any written submissions made by the lessee within the period stated in the notice.
- (i) that the chief executive proposes not to make an offer of a new lease;
- (ii) the reasons for the chief executive’s proposal not to make an offer of a new lease;
- (iii) that the lessee may, within the reasonable period stated in the notice, make written submissions about any matter relevant to the reasons for the chief executive’s proposal; and
- (a) as if a reference in the sections to deciding or refusing an application were a reference to making the decision; and
- (b) with other necessary changes.
