### sec.122 Deeds of grant of unallocated State land
A deed of grant of unallocated State land may be granted without competition to the State or MEDQ.
Also, a deed of grant of unallocated State land may be granted without competition if—
the Minister decides the land is needed for a public purpose and the grant is to a constructing authority; or
the Minister decides the land is not needed for a public purpose and 1 or more of the priority criteria apply.
The Minister must decide the purchase price for the land in the way prescribed by regulation.
For the granting, without competition, of a deed of grant of unallocated State land in the master plan area under the Implementation of The Spit Master Plan Act 2020 , see section 8 of that Act.

(sec.122-ssec.1) A deed of grant of unallocated State land may be granted without competition to the State or MEDQ.
(sec.122-ssec.2) Also, a deed of grant of unallocated State land may be granted without competition if— the Minister decides the land is needed for a public purpose and the grant is to a constructing authority; or the Minister decides the land is not needed for a public purpose and 1 or more of the priority criteria apply.
(sec.122-ssec.3) The Minister must decide the purchase price for the land in the way prescribed by regulation.
- (a) the Minister decides the land is needed for a public purpose and the grant is to a constructing authority; or
- (b) the Minister decides the land is not needed for a public purpose and 1 or more of the priority criteria apply.
