### sec.121 Leases of unallocated State land
A lease of unallocated State land may be granted without competition if—
the land is needed for a public purpose; or
the Minister decides—
the land is not needed for a public purpose; and
exposure to public competition is inappropriate or 1 or more of the priority criteria apply.
To remove any doubt, it is declared that a lease may be granted to the State, without competition.

(sec.121-ssec.1) A lease of unallocated State land may be granted without competition if— the land is needed for a public purpose; or the Minister decides— the land is not needed for a public purpose; and exposure to public competition is inappropriate or 1 or more of the priority criteria apply.
(sec.121-ssec.2) To remove any doubt, it is declared that a lease may be granted to the State, without competition.
- (a) the land is needed for a public purpose; or
- (b) the Minister decides— (i) the land is not needed for a public purpose; and (ii) exposure to public competition is inappropriate or 1 or more of the priority criteria apply.
