### sec.103 Issue of road licence
The Minister may issue a road licence over a road only to—
an adjoining owner; or
another person, if the road licence is only for allowing the person holding the licence to make structural improvements—
mentioned in section 104 (b) (ii) or (iii) ; and
for the benefit of land of which the person is the registered owner (other than a trustee of a deed of grant in trust), lessee or trustee.

However, the Minister need not issue the road licence only to the person who applied for the road closure.
If the Minister issues a road licence under subsection (1) , the registrar of titles must register a covenant of a type mentioned in section 373A (5) (c) over—
for a road licence issued to an adjoining owner—the licence land and the adjoining owner’s land; or
otherwise—the licence land and the land for the benefit of which the road licence is issued.
