### sec.21 Fee exemption for State-related complainant
Despite section 20 (1) , no fee is payable under schedule 3 , items 1 to 4 or 5(a) by a State-related complainant.
If—
a complaint is made by a State-related complainant; and
a court makes an order against the defendant in relation to the complaint;
the court must order the defendant to pay to the clerk of the court the amount of any filing fee stated in schedule 3 , items 1 to 3 that would have been payable in relation to the complaint by the State-related complainant if subsection (1) had not applied.
In this section—
State-related complainant means—
the Sovereign; or
the State or a person acting for the State; or
an entity, or a person acting for an entity, whose expenditure is entirely payable out of the consolidated fund.

(sec.21-ssec.1) Despite section 20 (1) , no fee is payable under schedule 3 , items 1 to 4 or 5(a) by a State-related complainant.

(sec.21-ssec.3) In this section— State-related complainant means— the Sovereign; or the State or a person acting for the State; or an entity, or a person acting for an entity, whose expenditure is entirely payable out of the consolidated fund.
- (a) a complaint is made by a State-related complainant; and
- (b) a court makes an order against the defendant in relation to the complaint;
- (a) the Sovereign; or

- (c) an entity, or a person acting for an entity, whose expenditure is entirely payable out of the consolidated fund.
