### sec.46 Time of making application
Subject to any other enactment, an application for review must be made—
as soon as possible and, in any event, within 3 months after the day on which the grounds for the application arose; or
if the court extends the period of 3 months—before the end of the extended period.
If the relief sought in an application for review is a certiorari order in relation to any judgment, order, conviction or other proceeding, the day on which the grounds for the application arose is, for the purposes of subsection (1) , taken to be the day of the making of the judgment, order, conviction or other proceeding.
